This Privacy Policy describes how Gatherings LLC dba Gaytherings ("Gaytherings," "we," "us," or "our") collects, uses, discloses, and otherwise processes Personal Information in connection with your access to and use of our platform, website, and related services (collectively, the "Services").
Gaytherings provides a platform that connects Organizers and Attendees for events that may involve sensitive, personal, or identity-related topics. We are committed to protecting your privacy; however, your use of the Services may involve sharing information with other Users or making information publicly available, and you should carefully consider what information you choose to provide.
This Privacy Policy explains your privacy rights and choices and how we handle your Personal Information. Capitalized terms not defined below have the meaning given to them in our Terms of Service.
Acceptance. By accessing or using the Services, you acknowledge that you have read and understand this Privacy Policy and agree to the collection, use, and disclosure of your Personal Information as described herein. If you do not agree, you must not access or use the Services.
Updates. We may modify this Privacy Policy at any time by posting an updated version on the Services. If we make material changes, we may provide notice through the Services or by email, at our discretion. Your continued use of the Services after the effective date of any updates constitutes your acceptance of the revised Privacy Policy.
"Personal Information" means information that identifies, relates to, or could reasonably be linked to an individual or household, such as name, email address, transaction history, usage data, or other similar information.
We collect Personal Information as necessary to provide, operate, and improve the Services. The types of Personal Information we collect depend on how you interact with the Services and generally include information you provide directly, information collected automatically, and information received from third parties.
Gaytherings is a platform that connects Attendees and Organizers. Personal Information shared between Users through the Services is provided directly by Users and is controlled by the receiving party. Gaytherings does not control how Users independently collect, use, store, or disclose Personal Information obtained through the Services. Users act as independent controllers of such information and are solely responsible for ensuring that their use complies with applicable laws. Personal Information shared through the Services may be visible to other Users and used by them outside our control. To the extent applicable under data protection laws, Gaytherings acts as a service provider or processor with respect to certain Personal Information and as an independent controller with respect to other Personal Information.
We collect Personal Information that you provide to us when you create an account, use the Services, communicate with us, or otherwise interact with the Services. We limit the Personal Information we collect to what is reasonably necessary to provide and improve the Services. Depending on how you use the Services, the Personal Information you provide may include:
Contact Information. Name, email address, mailing address, billing address, telephone number, and profile image.
Business Information. Business name, contact details, website, and related profile information.
Membership Information. Information submitted in connection with membership, invitation-only, waitlist, or application-based features made available through the Services, including application responses, questionnaire or form submissions, invitation status, approval or denial status, membership preferences, and related communications.
Payment Information. Payment information is collected and processed by our third-party Payment Processor. We may receive limited transaction details, such as your name, transaction amount, and transaction status.
Account Information. Email address used for sign-in, display name, account preferences (including your saved location and community preferences, as described in Section 1.2), and account activity. We use email-based one-time passcode authentication; we do not use or store account passwords.
Communications. Information contained in communications you send or receive through the Services.
Content and Submissions. Information, data, text, images, videos, files, feedback, and other content you upload, create, or make available through the Services, including content you provide on behalf of others.
Testimonials. Testimonials or feedback you choose to provide for publication, subject to your consent.
Support Information. Information you provide when requesting customer support, including support requests and related attachments.
If you provide Personal Information about other individuals, including Attendees, you represent and warrant that you have the right to provide such information and that your collection and use of such information complies with applicable laws.
Certain information you provide, such as your User name or Event-related content, may be visible to other Users. You should not provide Personal Information that you do not wish to be shared or made visible through the Services.
We do not require you to provide sensitive Personal Information in order to use the Services. However, due to the nature of the Services and Events, you or other Users may choose to share information that could be considered sensitive. This may include, without limitation, information revealing racial or ethnic origin, sexual orientation, sex life, gender identity, religious or philosophical beliefs, political opinions, health information, or membership in a trade union, as well as other personal information such as identity, personal preferences, affiliations, or community participation. You acknowledge that any information you choose to share may be visible to other Users and that you do so at your own discretion and risk.
Location and community preferences. The Services allow you to browse Events by location and by community focus. If you create an account, you may choose to save these preferences so that the Services show you relevant Events by default. A saved community preference may reveal or suggest information about your identity, orientation, or community participation. We use saved location and community preferences solely to personalize the Events shown to you within the Services. We do not sell this information, do not share it with third parties for advertising, and do not use it for any form of targeted advertising. You can change or clear your saved preferences at any time in your account settings, and you can use the Services without saving any preferences at all.
Participation in certain Events, including application-based, invite-only, or membership-related features, may indirectly reveal information about your interests, affiliations, or community participation.
You are responsible for any sensitive Personal Information that you choose to provide, upload, submit, or share through the Services, including through profiles, Event participation, forms, applications, communications, or other content. You should carefully consider whether to share such information through the Services.
Gaytherings does not intentionally collect or process sensitive Personal Information for purposes beyond providing and operating the Services. We do not require, and you should not provide, sensitive Personal Information that is not necessary for your use of the Services or interest in any Event. To the extent sensitive Personal Information is processed through the Services, such processing is based on your voluntary submission of the information and your use of the applicable Services or features.
When you access or use the Services, we may automatically collect certain information about your device and usage of the Services, including:
Usage Information. Pages viewed, features used, actions taken, timestamps, and general interaction data.
Device Information. IP address, browser type, operating system, device identifiers, and network information.
Approximate Location. General location derived from your IP address. Location information may be associated with Events or activities on the Services. You should use discretion when accessing or interacting with Events and consider your privacy preferences when enabling location features.
Technical and Log Data. Access logs and other technical data related to your use of the Services.
We use this information to operate, maintain, secure, and improve the Services, including to analyze usage trends, detect and prevent fraud, and ensure the proper functioning of the Services. This information may be considered Personal Information under applicable law. We do not use automatically collected information for targeted advertising.
We take steps to limit how automatically collected information is associated with individual Users. In general, such information is maintained in a de-identified or aggregated form and is segregated from account information or other data that directly identifies you. We also use encryption and other safeguards designed to protect this information and reduce the risk of unauthorized access or re-identification. However, you acknowledge that no method of data handling or transmission is completely secure, and that information that does not directly identify you may, in some circumstances, be capable of being associated with you or your account when combined with other information. While our practices are designed to reduce this risk, we cannot guarantee that re-identification will never occur.
Cookies are small text files placed on your device that help us recognize your browser or device and support functionality such as account authentication, security, preferences, and analytics. Our cookie banner groups Cookies into the following categories:
Necessary Cookies. Required to operate the Services, maintain security, enable core features, and remember your cookie choices and interface preferences.
Analytics Cookies. Used, with your consent, to understand how Users interact with the Services so we can improve performance and usability.
Marketing Cookies. Would be used to show you relevant content about Events and Organizers. We do not currently use Marketing Cookies.
We do not use Cookies for cross-context behavioral advertising or to track your activity across third-party websites for advertising purposes. You can manage your choices through our cookie banner, the "Cookie preferences" link in the footer of our website, or your browser or device settings. Please note that disabling Cookies may affect the availability or functionality of certain features of the Services.
We may advertise the Services on third-party platforms, such as search engines and social networks, to reach people who may be interested in Gaytherings. These campaigns are managed within the third-party platforms and are based on information those platforms hold about their own users, such as search terms.
We do not use remarketing or retargeting technologies on the Services, do not place advertising tags or pixels on the Services, and do not disclose your Personal Information to advertising platforms to target you or others with ads. We do not engage in cross-context behavioral advertising as defined under applicable law. If our advertising practices change, we will update this Privacy Policy and our Cookies Policy and provide any required consent or opt-out mechanisms before such practices take effect.

We may receive Personal Information about you from third parties in connection with your use of the Services.
Organizers and User Interactions. When you interact with Organizers or other Users through the Services, including when you register for, apply to attend, request access to, participate in, or attend Events, your Personal Information may be shared with the applicable Organizer or other Users through the Services. Organizers may also provide information to Gaytherings regarding Membership Events, invitation workflows, application reviews, approvals, denials, waitlists, or other Event-related activities. Personal Information shared between Users or provided by Organizers through the Services is controlled by the applicable receiving party, and Organizers and Users may act as independent controllers of such information. Gaytherings does not control how Organizers or other Users use Personal Information they obtain through the Services. Organizers are independently responsible for their own privacy practices and use of Personal Information obtained through the Services.
Third-Party Services. If you choose to connect or interact with third-party services (such as payment processors, embedded integrations, or account connection services), we may receive information from those services according to their terms and your authorization. This information may include your name, contact information, account details, and transaction-related information.
Service Providers. We may receive Personal Information from service providers that support the operation of the Services, such as payment processors, analytics providers, hosting providers, communications providers, and other infrastructure providers. These providers process information on our behalf and according to applicable laws.
Third-Party Technologies. Some third parties may use Cookies or similar technologies in connection with the Services. We do not control these technologies or how third parties use the information they collect. For more information, please see our Cookies Policy.
In certain circumstances, Gaytherings may process Personal Information on behalf of Organizers in connection with the Services, including Membership Events, application workflows, invitation-based Events, communications, ticketing, or other Organizer-managed activities.
Where applicable under data protection laws, the applicable Organizer may act as the "controller" (or similar designation under applicable law) of certain Personal Information processed through the Services, and Gaytherings may act as a "processor" or "service provider" on behalf of the Organizer with respect to such processing activities.
Gaytherings processes such Personal Information according to the Organizer's instructions as reflected through the functionality of the Services, the applicable agreements between Gaytherings and the Organizer, and our Global Data Processing Agreement. Notwithstanding the foregoing, Gaytherings may independently collect, use, retain, and process Personal Information as a separate controller for purposes described in this Privacy Policy.
Users who have questions regarding an Organizer's use of Personal Information should contact the applicable Organizer directly.
The Services may allow you to share Personal Information with other Users or make information publicly available, including through profiles, Event participation, or communications. You are solely responsible for any Personal Information that you choose to share through the Services. Once shared, such information may be accessed, collected, copied, or used by other Users or third parties beyond our control. You should not share Personal Information that you wish to keep private or confidential.
While Users are required to comply with the Terms of Service, Gaytherings does not control or guarantee how other Users will use or protect the Personal Information you share with them. Gaytherings may, but is not obligated to, monitor, review, or remove User-submitted content, including Personal Information, at its discretion. If you believe that Personal Information has been improperly posted on the Services, you may contact us, and we may, in our discretion, review and take appropriate action.
We use Personal Information for the following purposes, depending on how you interact with the Services:
Providing and Operating the Services. To create and manage User accounts, provide access to the Services and their features, enable the creation, promotion, and participation in Events, authenticate Users, maintain account security, and personalize User preferences and settings.
Facilitating Events and User Interactions. To process Event registrations and transactions, facilitate Events, manage Event status (including scheduling, completion, and updates), and support communications between Attendees and Organizers.
Membership Features. To facilitate membership applications, invitation workflows, waitlists, organizer review processes, and access-control features available through the Services.
Communications. To respond to inquiries, provide customer support, and send transactional or service-related communications, such as account confirmations, updates, security alerts, and changes to our terms or policies.
Analytics and Improvement. To analyze usage trends, monitor performance, improve the reliability and security of the Services, and develop new features and functionality.
Legal, Compliance, and Safety. To comply with applicable laws and legal processes, enforce our Terms of Service and other agreements, and detect, prevent, and respond to fraud, misuse, security incidents, or other harmful activity.
Marketing Communications. Where permitted by applicable law and subject to your preferences, to send communications about Gaytherings products, features, or updates. You may opt out of marketing communications at any time using the unsubscribe mechanism provided or by contacting us.
We may share Personal Information in the following circumstances, and only to the extent necessary to provide, operate, and support the Services and related features. Gaytherings acts as a platform provider, and Users may independently determine how they use Personal Information obtained through the Services.
Service Providers. We may share Personal Information with third-party service providers that perform services on our behalf, such as hosting, infrastructure, analytics, customer support, payment processing, security, and communications. These providers are authorized to use Personal Information only as necessary to perform services for us and are contractually required to protect such information. A list of the sub-processors we use in connection with organizer data is available at https://www.gaytherings.com/legal/subprocessors.
Organizers and Attendees. When you interact with other Users through the Services, including registering for or hosting Events, we may share relevant Personal Information with the applicable Organizer or Attendee to facilitate participation, communication, and completion of the Event. Personal Information shared between Users is controlled by the receiving party, and Users may act as independent controllers of such information.
Organizers and Membership Features. If you apply for, request access to, or participate in any membership, invite-only, or application-based feature, we may share your application information, membership status, and related communications with the applicable Organizer.
Payments and Financial Transactions. We share limited Personal Information with our third-party Payment Processor (such as Stripe) to facilitate payments. The Payment Processor collects and processes payment information directly, and its use of Personal Information is governed by its own privacy policies. Gaytherings does not control and is not responsible for the Payment Processor's privacy practices.
Legal Requirements and Protection of Rights. We may disclose Personal Information if required to do so by law or if we believe in good faith that such disclosure is necessary to comply with legal obligations, enforce our Terms of Service or other agreements, or protect the rights, property, or safety of Gaytherings, our Users, or others.
Business Transfers. Personal Information may be transferred in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction, subject to appropriate confidentiality protections.
With Your Consent. We may share Personal Information for any other purpose with your consent.
Aggregated or De-Identified Information. We may share aggregated or de-identified information that does not identify any individual with third parties for business or analytical purposes.
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, or destruction. These safeguards are appropriate to the nature of the information and the risks associated with its processing. Access to Personal Information is limited to authorized personnel and service providers who require such access to perform their duties and who are subject to confidentiality and security obligations.
You are responsible for maintaining the security of the email account you use to sign in to the Services, since one-time passcodes are delivered to that email address, and for taking appropriate steps to protect your devices and accounts from unauthorized access. No method of transmission over the Internet or method of electronic storage is completely secure. Accordingly, while we take reasonable measures to protect Personal Information, we cannot guarantee its absolute security. In the event of a security incident involving Personal Information, we will take reasonable steps to investigate and, where required by applicable law, notify affected individuals and authorities.

We retain Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide and operate the Services, facilitate Events, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the nature of the information, how it is used, and applicable legal or contractual requirements. For example:
Account Information. Retained while your account is active and for a reasonable period thereafter.
Transaction and Event Information. Retained as necessary for Event facilitation, payment processing, and compliance with legal, tax, and accounting obligations.
User Content and Communications. Retained as necessary to provide the Services and support User interactions.
We may retain Personal Information for longer periods where required or permitted by applicable law, including for compliance, dispute resolution, and enforcement purposes. When Personal Information is no longer required for these purposes, we take reasonable steps to delete, anonymize, or securely dispose of it, subject to applicable legal requirements.
Gaytherings is a company based in the United States. We store Personal Information on servers located in the European Union. Your Personal Information may be accessed, processed, or transferred to the United States or other jurisdictions where we or our service providers operate. Where required by applicable law, we rely on appropriate safeguards for cross-border data transfers, such as standard contractual clauses or other lawful transfer mechanisms. We take reasonable measures to protect Personal Information and to ensure that it is handled in accordance with this Privacy Policy.
By using the Services, you acknowledge that your Personal Information may be transferred to and processed in jurisdictions outside your country of residence, including the United States. Data protection laws in these jurisdictions may differ from those in your country of residence, and we cannot guarantee that they will provide the same level of protection.
You may opt out of receiving marketing communications from us at any time by clicking the "unsubscribe" link in our emails, following the instructions provided in the communication, or by contacting us at support@gaytherings.com. Please note that you may continue to receive transactional or service-related communications, such as account notifications, security alerts, or updates related to your use of the Services.
You may control Cookies through our cookie banner and the "Cookie preferences" link in the footer of our website, as well as your browser or device settings, including by deleting existing Cookies, refusing Cookies, or configuring your settings to notify you when Cookies are being used. Please note that disabling or refusing Cookies may affect the availability or functionality of certain features of the Services.

The Services may contain links to third-party websites or services that are not owned or controlled by Gaytherings. This Privacy Policy does not apply to such third-party websites or services. Inclusion of a link does not imply endorsement of the third-party website or its practices. We are not responsible for the privacy practices or content of third-party websites. If you access a third-party website through the Services, you do so at your own risk and are subject to the terms and privacy policies of that third party. We encourage you to review the privacy policies of any third-party websites before providing Personal Information.
Certain features of the Services, including Events and other paid offerings, require payment processing. All payments made through the Services are processed by our third-party Payment Processor. When you make or receive a payment through the Services, your payment information is collected and processed directly by the Payment Processor. Gaytherings does not store full payment card numbers or bank account details.
The Payment Processor's collection and use of your Personal Information is governed by its own terms and privacy policies. Gaytherings does not control and is not responsible for the Payment Processor's privacy or security practices. We may receive limited information from the Payment Processor, such as transaction identifiers, payment status, and confirmation of successful or failed transactions, which we use to operate the Services, facilitate Events, and maintain transaction records.
The Services are intended for adults. Individuals under 18 are not permitted to use the Services. We do not knowingly collect Personal Information from anyone under 18, and we do not knowingly collect Personal Information from children under the age of 13. If we become aware that a child under 13 has used the Services or provided Personal Information, we will take reasonable steps to delete such information. If you believe that a person under the age of 18 has provided Personal Information through the Services, please contact us at support@gaytherings.com.
California Users of the Services may have additional rights afforded to them under California privacy laws.
Additional definitions. "CCPA" or "California Consumer Privacy Act" means California Civil Code § 1798.100 et seq., as amended by the California Privacy Rights Act of 2020. "Consumer," "Business," "Sell," "Share," and "Service Provider" have the meanings given to them in the CCPA.
If the processing of your Personal Information is subject to the CCPA, you have the right to:
request that we disclose the categories and specific pieces of Personal Information we collect, use, disclose, and sell;
know the categories of Personal Information that we collect and the purposes for which we collected or used such Personal Information and whether that information is sold or shared;

Identifiers. Examples: name, alias, age, postal address, email address, IP address, account name, online identifiers, and similar identifiers. Shared with: service providers, payment processors, third-party vendors authorized by you, and other Users with whom you choose to share information through the Services.
Personal Information Described in California Civil Code § 1798.80(e). Examples: name, mailing address, billing address, and telephone number. Shared with: service providers, payment processors, third-party vendors authorized by you, and other Users with whom you choose to share information through the Services.
Commercial Information. Examples: records of Events purchased, registrations, and transaction history. Shared with: service providers, payment processors, and third-party vendors as necessary to facilitate transactions and provide the Services.
Internet or Network Activity Information. Examples: usage data, browsing interactions, and activity on the Services. Shared with: service providers and analytics providers that support the operation and improvement of the Services.
We may collect, use, and disclose the categories of Personal Information described above for business and commercial purposes, including: to provide, operate, and improve the Services; to communicate with you, respond to inquiries, and provide customer support; to facilitate Events and related transactions; to comply with applicable laws, regulations, legal processes, or governmental requests; for internal administrative, auditing, and operational purposes; and to detect, prevent, and address security incidents, fraud, or other illegal or harmful activity. We may also use Personal Information for purposes described to you at the time of collection or as otherwise permitted by applicable law.
We do not sell your Personal Information, and we do not share your Personal Information for cross-context behavioral advertising. We use analytics tools solely to understand how Users interact with the Services and to improve performance and functionality. We configure these tools to limit their use of Personal Information and do not use them for targeted advertising purposes.
If you are a California resident, you have the right to request that we not sell or share your Personal Information. Because we do not sell or share Personal Information, there is currently nothing to opt out of. If our data practices change in the future in a way that would constitute a "sale" or "sharing" under applicable law, we will update this Privacy Policy and provide any required rights and opt-out mechanisms, including recognition of opt-out preference signals, before such practices take effect. The Services are not available to individuals under 18. If, notwithstanding this restriction, a California resident under 18 has publicly posted content or information through the Services, they may have the right under California Business and Professions Code Section 22581 to request its removal. This right applies only to content that the minor personally posted and does not guarantee complete or comprehensive removal, as certain content may be retained as required or permitted by law. We may require verification of identity and, where appropriate, may require that such requests be submitted by a parent or legal guardian.
Some web browsers offer a "Do Not Track" (DNT) setting. There is no widely accepted standard for responding to DNT signals, and the Services do not currently respond to them. Because we do not sell or share Personal Information, opt-out preference signals such as Global Privacy Control (GPC) currently have no sale or sharing to act upon. If our practices change, we will honor applicable opt-out preference signals as required by law.
Under California Civil Code Section 1798.83 (the "Shine the Light" law), California residents may request information about the categories of Personal Information we disclosed to third parties for their direct marketing purposes, if any, during the preceding calendar year. You will not be charged a fee to access your Personal Information or to exercise your rights, unless your request is manifestly unfounded, repetitive, or excessive, in which case we may charge a reasonable fee or decline to act on the request.
We process Personal Information only where we have a valid legal basis to do so. Depending on the context, that may include:
Performance of a Contract. To provide the Services and related features, including account management, facilitating Events, processing transactions, and enabling interactions between Users.
Legitimate Interests. To operate, secure, and improve the Services; communicate with Users; analyze usage; prevent fraud and misuse; and support our business operations, provided that such interests are not overridden by your rights and interests.
Legal Obligations. To comply with applicable laws, regulations, legal processes, and enforcement obligations.
Consent. Where required by applicable law, such as for analytics Cookies, certain optional communications, or the processing of special category data you voluntarily provide (including saved community preferences). Where we rely on consent, you may withdraw it at any time.
Personal Information is stored on servers located within the European Economic Area. Personal Information may nonetheless be accessed from, transferred to, and processed in countries outside the EEA or the United Kingdom, including the United States, where we and certain of our service providers operate. Where required by applicable law, we rely on appropriate safeguards to protect Personal Information transferred internationally, such as standard contractual clauses or other lawful transfer mechanisms.
